This is a symbol of family well-being, peace, tranquility. this is an image of our common home, the common Motherland of all people living in Kazakhstan. Happiness in it depends on the well-being of everyone, just as the strength of a shanyrak depends on the reliability of its supports (supports). Dome poles - uziks, evenly diverging from the center along the blue space of the coat of arms, resemble the rays of the sun, which symbolizes the source of life and warmth. From the shanyrak there is a kerege - a sliding lattice base of the yurt. It symbolizes the unity of the three zhuz, which ensures its strength. Using the language of heraldry, the authors decided to depict the peace-loving essence of the Kazakhs.

1. The State Flag of the Republic of Kazakhstan must be raised (installed, placed):

1) on the buildings of the Residence of the President of the Republic of Kazakhstan, Parliament, Senate and Mazhilis, Government, ministries, government bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, their departments and territorial divisions, the Constitutional Council, the Supreme Court and local courts of the Republic of Kazakhstan, local representative and executive bodies, local government bodies, government organizations, as well as on the buildings of embassies, permanent missions to international organizations, trade missions, other official foreign institutions, residences of the heads of foreign institutions of the Republic of Kazakhstan and on their vehicles in accordance with the protocol practice of the host states - constantly;

5-1) in the premises (part of the premises) allocated for the exhibition dedicated to state symbols, state legal entities, national management holdings, national holdings, national companies, as well as other joint-stock companies and limited liability partnerships, in respect of which the Republic of Kazakhstan acts sole shareholder (participant);

6) on sea vessels, inland navigation vessels and other means of transportation, on which the President of the Republic of Kazakhstan, the chairmen of the chambers of the Parliament of the Republic of Kazakhstan, the Prime Minister of the Republic of Kazakhstan are present as officials;

7) as a stern flag on ships registered in the Republic of Kazakhstan, in accordance with the established procedure;

8) on warships and vessels of the Republic of Kazakhstan - in accordance with military regulations;

9) in military formations, units, divisions and institutions of the Armed Forces, other troops and military formations of the Republic of Kazakhstan - on the days of national and state holidays of the Republic of Kazakhstan, when taking the oath;

10) during the celebration of the Day of State Symbols of the Republic of Kazakhstan, official and solemn ceremonies, sporting events in the manner determined by the Government of the Republic of Kazakhstan;

11) in educational organizations implementing educational programs of secondary general, primary vocational, secondary vocational, higher vocational and postgraduate vocational education, at the opening ceremonies of the new academic year and the end of the academic year;

12) at a meeting of heads of state, parliaments and governments of foreign states visiting the Republic of Kazakhstan on state and official visits.

The procedure for using (installing, placing) the State Flag and its image in formations, military units, divisions, institutions of the Armed Forces and other troops and military formations is determined by general military regulations.

The National Flag, installed on buildings on a permanent basis, must be illuminated at night.

The State Flag of the Republic of Kazakhstan can be installed on other buildings (indoors) at the request of their owners.

The procedure for using (installing, placing) the State Flag and its image is determined by the Government of the Republic of Kazakhstan.

2. The image of the National Flag must be placed:

1) on the websites of the President of the Republic of Kazakhstan, Parliament, Government, ministries, government bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, their departments and territorial divisions, the Constitutional Council of the Republic of Kazakhstan, the Supreme Court and local courts of the Republic of Kazakhstan, local representative and executive bodies, as well as foreign institutions of the Republic of Kazakhstan in the manner determined by the Government of the Republic of Kazakhstan;

2) on aircraft, as well as on spacecraft of the Republic of Kazakhstan.

The image of the National Flag can also be placed on other material objects.

3. The State Flag, regardless of its size, must comply with the national standard.

If the State Flag does not comply with the national standard, it is subject to replacement and destruction in the manner determined by the Government of the Republic of Kazakhstan.

The image of the State Flag cannot be used as a heraldic basis for the flags of public associations and other organizations.

The image of the State Flag can be used as an element or heraldic basis of state awards, banknotes and coins of the National Bank of the Republic of Kazakhstan.

4. On the occasion of national mourning, the State Flag is lowered to half the height of the flagpole during the period of national mourning.

Article 5. Simultaneous use of the State Flag of the Republic of Kazakhstan and other flags on the territory of the Republic of Kazakhstan

1. When simultaneously hoisting (installing, placing) the State Flag of the Republic of Kazakhstan, flags of foreign states, public associations and other organizations, the size of the State Flag of the Republic of Kazakhstan should not be less than the size of other flags.

At the same time, the State Flag of the Republic of Kazakhstan is placed no lower than other flags.

2. Flags of public associations and other organizations cannot be identical to the State Flag of the Republic of Kazakhstan.

3. Flags of foreign states used by foreign organizations and representative offices operating on the territory of the Republic of Kazakhstan, with the exception of diplomatic missions, consular offices, international organizations and (or) their representative offices accredited in the Republic of Kazakhstan, are placed simultaneously with the State Flag of the Republic of Kazakhstan.

Chapter 3. STATE EMBRACE OF THE REPUBLIC OF KAZAKHSTAN

Article 6. Procedure for using the State Emblem of the Republic of Kazakhstan

1. The State Emblem must be placed:

1) on the buildings of the Residence of the President of the Republic of Kazakhstan, Parliament, Senate and Mazhilis, Government, ministries, government bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, their departments and territorial divisions, the Constitutional Council of the Republic of Kazakhstan, the Supreme Court and local courts of the Republic of Kazakhstan, connections , military units, divisions and institutions of the Armed Forces, other troops and military formations, local representative and executive bodies, as well as on the buildings of embassies, permanent missions to international organizations, trade missions, other official foreign institutions, residences of heads of foreign institutions of the Republic of Kazakhstan - permanently;

2) in the offices of the President of the Republic of Kazakhstan, chairmen of the chambers of Parliament of the Republic of Kazakhstan, Prime Minister, Secretary of State, Chairman of the Constitutional Council, Chairman of the Supreme Court and chairmen of local courts of the Republic of Kazakhstan, Chairman of the Central Election Commission, Commissioner for Human Rights of the Republic of Kazakhstan, heads of ministries, state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, their departments and territorial divisions, heads of local representative and executive bodies, heads of foreign institutions of the Republic of Kazakhstan - constantly;

3) in the halls where joint and separate meetings of the Senate and Mazhilis of the Parliament of the Republic of Kazakhstan are held, meetings of the coordination and working bodies of the chambers of the Parliament of the Republic of Kazakhstan, the Government, in the meeting rooms of the Constitutional Council, in the courtrooms of the Supreme Court and local courts of the Republic of Kazakhstan, in the halls meetings of the boards of central, local representative and executive bodies, government bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, in the halls for presenting state and government awards of the Republic of Kazakhstan, in the reception halls of foreign institutions of the Republic of Kazakhstan, as well as in the premises for registering births and marriages - constantly;

4) in the premises (part of the premises) allocated for the exhibition dedicated to state symbols, state legal entities, national management holdings, national holdings, national companies, as well as other joint-stock companies and limited liability partnerships, in respect of which the Republic of Kazakhstan is the sole shareholder (participant).

The procedure for using (installing, placing) the State Emblem and its image in formations, military units, divisions, institutions of the Armed Forces and other troops and military formations is determined by general military regulations.

2. The image of the State Emblem must be placed:

1) on seals and forms of documents of the President of the Republic of Kazakhstan and his Administration, Parliament, its chambers and their apparatus, the Bureau of the Chambers of the Parliament of the Republic of Kazakhstan, the Government and the Office of the Prime Minister, ministries, government bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, their departments and territorial divisions, the Constitutional Council of the Republic of Kazakhstan, the Supreme Court and local courts of the Republic of Kazakhstan, formations, military units, divisions and institutions of the Armed Forces, other troops and military formations, local representative, executive bodies and other government organizations;

1-1) on notary seals;

2) on official publications of the President of the Republic of Kazakhstan, Parliament, Government, Constitutional Council and the Supreme Court of the Republic of Kazakhstan;

3) on banknotes and coins of the National Bank of the Republic of Kazakhstan, government securities of the Republic of Kazakhstan;

4) on an identity card, birth certificate, passport and other passports issued to citizens of the Republic of Kazakhstan, service IDs of employees of government bodies and government organizations;

5) on border posts installed on the State Border of the Republic of Kazakhstan;

6) on the websites of the President of the Republic of Kazakhstan, Parliament, Government, ministries, government bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, their departments and territorial divisions, the Constitutional Council of the Republic of Kazakhstan, the Supreme Court and local courts of the Republic of Kazakhstan, local representative and executive bodies, as well as foreign institutions of the Republic of Kazakhstan in the manner determined by the Government of the Republic of Kazakhstan.

The image of the State Emblem can also be placed on other material objects.

3. The State Emblem, regardless of its size, must comply with the national standard.

If the State Emblem does not comply with the national standard, it is subject to replacement and destruction in the manner determined by the Government of the Republic of Kazakhstan.

4. It is prohibited to use the image of the State Emblem of the Republic of Kazakhstan on letterheads, seals and other details of non-governmental organizations and their officials, except in cases established by this Constitutional Law.

The State Emblem cannot be used as a heraldic basis for the coats of arms of public associations and other organizations.

The image of the State Emblem can be used on insignia and uniforms established for persons in military or other public service, as an element or heraldic basis for state awards of the Republic of Kazakhstan, as well as on sports suits and other sports accessories.

The procedure for using (installing, placing) the State Emblem and its image is determined by the Government of the Republic of Kazakhstan.

Article 7. Simultaneous use of the State Emblem of the Republic of Kazakhstan and other emblems on the territory of the Republic of Kazakhstan

When placing the State Emblem of the Republic of Kazakhstan and coats of arms of foreign states or coats of arms (heraldic sign) of a public association or other organization at the same time, the size of the State Emblem of the Republic of Kazakhstan should not be less than the size of other coats of arms.

At the same time, the State Emblem of the Republic of Kazakhstan is placed no lower than other coats of arms (heraldic signs).

Chapter 4. NATIONAL ANTHEM OF THE REPUBLIC OF KAZAKHSTAN

Article 8. Procedure for using the National Anthem of the Republic of Kazakhstan

1. The National Anthem is performed:

1) upon assuming the office of the President of the Republic of Kazakhstan - after taking the oath;

2) at the opening and closing of sessions of the Parliament of the Republic of Kazakhstan;

3) at the opening of ceremonial meetings and sessions dedicated to national and state holidays of the Republic of Kazakhstan, as well as other celebratory events;

4) when television and radio channels go on air every day at the beginning and at the end of their broadcast;

5) at the opening of monuments, obelisks and other structures to commemorate the most important historical events in the life of the people of the Republic of Kazakhstan;

6) when raising the State Flag of the Republic of Kazakhstan during official and solemn ceremonies, sporting events held by government bodies, as well as public associations and other organizations of the Republic of Kazakhstan;

7) at a meeting of heads of foreign states visiting the Republic of Kazakhstan on state or official visits, after the performance of the national anthem of the corresponding foreign state;

8) in educational organizations implementing educational programs of secondary general, primary vocational, secondary vocational, higher vocational and postgraduate vocational education, during the opening ceremonies of a new academic year and the end of the academic year, as well as during other special events;

9) when holding sporting events with the participation of the national (team) team of the Republic of Kazakhstan.

Article 9. The procedure for performing the National Anthem of the Republic of Kazakhstan

1. During the public performance of the National Anthem, those present sing (listen) standing, while citizens of the Republic of Kazakhstan put their right hand to their heart.

When state bodies and other organizations of the Republic of Kazakhstan hold events on the territory of foreign states, the National Anthem is performed in accordance with this Constitutional Law, as well as the legislation and protocol practice of the host state and local customs.

The ceremonial raising and installation of the State Flag of the Republic of Kazakhstan is accompanied by the performance of the State Anthem, while those present turn to face the Flag.

2. The National Anthem is performed in an orchestral, choral, orchestral-choral or other vocal and instrumental performance. In this case, sound recording means can be used.

An abbreviated performance of the National Anthem of the Republic of Kazakhstan is allowed.

3. The State Anthem is performed in the state language in strict accordance with the approved text and musical edition.

4. The musical edition and text of the National Anthem of the Republic of Kazakhstan cannot be used as a basis for other musical works and other works of art.

Chapter 5. COMPETENCE OF STATE BODIES

Article 10. Competence of the Government of the Republic of Kazakhstan

The competence of the Government includes:

1) organization of work on the production of standards of the State Flag and State Emblem of the Republic of Kazakhstan, corresponding to national standards and their images approved by this Constitutional Law;

2) approval of the rules for replacing and destroying the State Flag, State Emblem of the Republic of Kazakhstan that do not meet national standards;

3) approval of the rules for the use (installation, placement) of the State Flag, the State Emblem of the Republic of Kazakhstan and their images, as well as the text of the State Anthem of the Republic of Kazakhstan;

3-1) approval of the rules for celebrating the Day of State Symbols of the Republic of Kazakhstan;

4) determination of the authorized body in the field of state symbols of the Republic of Kazakhstan;

5) performance of other functions assigned to him by the Constitution of the Republic of Kazakhstan, laws of the Republic of Kazakhstan and acts of the President of the Republic of Kazakhstan.

Article 11. Competence of authorized bodies in the field of state symbols of the Republic of Kazakhstan

1. Authorized body in the field of technical regulation and metrology:

1) develops and approves national standards of the State Flag and State Emblem of the Republic of Kazakhstan;

2) develops standards of the State Flag and State Emblem of the Republic of Kazakhstan;

3) carries out licensing for the production of the State Flag and the State Emblem of the Republic of Kazakhstan;

4) exercises control over the licensee’s compliance with the conditions specified in the license in the manner established by the legislation of the Republic of Kazakhstan;

5) exercises other powers provided for by the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

2. The authorized body for the use of state symbols of the Republic of Kazakhstan:

1) develops rules for the replacement and destruction of the State Flag, State Emblem of the Republic of Kazakhstan that do not meet national standards;

2) creates an expert council on issues of state symbols and heraldic signs, and also develops and approves regulations on it;

3) exercises other powers provided for by the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

Article 12. Competence of the local executive body

The local executive body exercises control over the use (installation, placement) of state symbols of the Republic of Kazakhstan on the territory of the corresponding administrative-territorial unit.

Chapter 6. FINAL PROVISIONS

Article 13. Formation of respectful attitude towards state symbols of the Republic of Kazakhstan

1. Citizens of the Republic of Kazakhstan, as well as persons located on the territory of the Republic, are obliged to respect the state symbols of the Republic of Kazakhstan.

2. In order to educate citizenship and patriotism, love for one’s Motherland - the Republic of Kazakhstan, develop respect for the state symbols of the Republic of Kazakhstan, as well as understanding their essence and meaning, their study is included in the main general educational programs of educational organizations of secondary general, primary vocational, secondary vocational and higher professional education.

In educational organizations implementing educational programs of secondary general, primary vocational, secondary vocational and higher professional education, the State Flag is constantly installed in a specially designated prominent place, the State Emblem or their images are placed, as well as the text of the State Anthem of the Republic of Kazakhstan in the state language.

Article 14. Production of the State Flag, State Emblem of the Republic of Kazakhstan

The production of the State Flag, the State Emblem of the Republic of Kazakhstan is carried out in the presence of an appropriate license, issued in the manner established by the legislation of the Republic of Kazakhstan.

Article 15. Responsibility for violation of the legislation of the Republic of Kazakhstan regulating the production and use of state symbols of the Republic of Kazakhstan

Violation of the legislation of the Republic of Kazakhstan regulating the production and use of state symbols of the Republic of Kazakhstan entails liability established by the laws of the Republic of Kazakhstan.

Article 16. Procedure for the entry into force of this Constitutional Law

1. This Constitutional Law shall come into force upon the expiration of ten calendar days from the date of its official publication.

2. The Constitutional Law of the Republic of Kazakhstan of January 24, 1996 “On State Symbols of the Republic of Kazakhstan” (Gazette of the Parliament of the Republic of Kazakhstan, 1996, No. 1, Art. 178; 1997, No. 12, Art. 193) shall be declared invalid. 2006, N 1, art. 1).

June 4, 1992 - an important event occurred: the State symbols of Kazakhstan were adopted.

State symbols - heraldic images, created according to all the canons of modern political culture and historical self-identification, declared not only the fact of the country's state independence, but also the essence of the most important principles of building a new state.

An important attribute of state symbols is the coat of arms, which translated from German means “inheritance” or “share in the inheritance.” The history of coats of arms on Kazakh land begins with the appearance of the first state associations on it. In other words, the history of the coat of arms is the history of the state. As world experience shows, the characteristic features of the Coat of Arms of an individual state make it possible to distinguish it from another state. For example, the Saka tribes of the Early Iron Age had tribal totemic signs that made it possible to distinguish them from each other. Tamga meant a special sign, a sacred symbol, a family seal. On the clothes of the “Golden Man,” found during excavations of the Issyk mound of the 5th century BC, there were about 4 thousand decorations made in the “animal style” and made in the form of figurines of a leopard, mountain goat, argali, elk, horses and various birds. This is where the “koshkar muyiz” (argali horns) ornament, which is part of our Flag, was borrowed. The basis of the Coat of Arms was taken from the fabulous winged unicorns looking in opposite directions, which were located on the headdress of the “Golden Man”. When comparing the symbols of states with a similar history, it is clearly seen that they depict the same animals, for example, griffins and golden eagles, lions or horses - faithful companions of the nomadic Turks.

Such totemic symbols are often found in Uysun and Turkic-Mongolian legends, especially in the legends of Kok bori (Heavenly wolf). In the worldviews of the Turkic peoples, the wolf occupied a special totemic role. During the time of the Turkic Khaganate, “Kok bori” was depicted on the banners of the Turkic troops. Therefore, in the musical work of the famous Kazakh akyn Suinbay, who lived in the 19th century, there are the following words: “Borili menin bairagym, Borili bayrak koterse, Kozady kai-kaidagym...”. The Kazakh people have always considered the wolf a symbol of courage and courage. In subsequent times, the Kazakhs used tribal tamgas. Scientists have counted 84 tamgas of Kazakh clans, descended from 43 tribes. Tamgas, having various geometric shapes, were used as coats of arms and seals. Tamgas also served to designate clan, tribal and private property. The Kazakhs have preserved the custom of marking animals with tamga to this day.

The flag is a special sign of identity, independence, and statehood. Its history, dating back 5 thousand years, begins in the Middle East. According to researchers, the oldest flag was found in Iran; it depicted birds, animals, and faces of gods. The history of the blue color of the flag of Kazakhstan is connected with the symbols of the Turkic, Khazar, Seljuk Khaganates, the Timurid state, and the Kazakh Khanate. In the language of the ancient Turks, the meaning of the word “kok” also corresponded to the concepts of “east”, “eastern”. The sun on the flag of Kazakhstan is the oldest cosmic symbol known to all peoples, meaning the source of life, light. The history of the Kazakh people is in a genetic connection with the history of the Sakas, Usuns, Huns and other tribes that inhabited the territory of Kazakhstan in ancient times. The ancient Turks, who professed Tengrism, worshiped the Blue Sky, Sun, Water, Air, and Earth. Therefore, the blue color of the flag and symbolism reflect the historical continuity of the peoples living on the territory of Kazakhstan. The eagle depicted on the flag is known as a symbol of power and strength, therefore this heraldic sign is represented on many coats of arms and state emblems of countries around the world.

If we turn to the history of coats of arms of the colonial period, then as a result of the administrative-territorial reform of 1867–1868, the coats of arms of the cities of Kazakhstan were created. The Kazakh regions and cities that were part of the Russian Empire had coats of arms of the same type. For example, the cities of Uralsk, Guryev (modern Atyrau), Pavlodar, Semey, Ust-Kamenogorsk, Petropavlovsk, Kokshetau, Kostanay, Aktobe and others had coats of arms.

The Alash-Orda government, which arose after the overthrow of tsarism in 1917, considered at its meetings the issue of the need to create a coat of arms, but the issue remained unresolved. Therefore, in 1918, the newspaper “Kazak” published an article “Horde of the coat of arms (tanbasy)” with a call to take part in the development of the draft coat of arms. Considering the Soviet period (1920–1991), we clearly see that the coat of arms of the Kazakh SSR, like other union republics, was created on the basis of the coat of arms of the USSR. In its center, in red rays, there was a sickle and a hammer, and on the panel there was an inscription in Kazakh and Russian: “Proletarians of all countries, unite!” At the very top of the coat of arms there was a five-pointed star, at the bottom there was the inscription “KSSR” and “KSSR”. At the bottom of the red state flag of the Kazakh SSR there was a narrow blue stripe, reminiscent of the original color of the national banner. Historical documents contain information about the existence of Alash-Orda flags of white and green colors.

In 1991, a deep political crisis led to the collapse of the USSR and opened the way to freedom. The independence of our country was proclaimed. During these years, work began on the preparation of State symbols of the Republic of Kazakhstan. At the beginning of 1992, a Resolution of the Presidium of the Supreme Council was issued on the creation of a working group to prepare new state symbols of the Republic of Kazakhstan. In accordance with it, a commission was formed, its members included such famous figures as S. Abdildin, S. Zimanov, S. Abdrakhmanov, E. Shaimerdenov and others. A competition for projects of the Coat of Arms, Flag, and Anthem was also announced. Many representatives of creativity, talented poets, composers, and artists took part in it. 600 people took part in the competition for the State Flag and 1,200 projects were submitted, 245 projects of the State Emblem and 750 projects of the State Anthem were also proposed.

The anthem, personifying spiritual unity, is another important state symbol. During the years of independence, two Anthems were adopted (1992,2006). The authors of the text of the first Anthem were T. Moldagaliev, M. Alimbayev, K. Myrzaliev, Zh. Daribaeva and composers M. Tolebaev, E. Brusilovsky, L. Hamidi. The melody of the Soviet period anthem remained unchanged. However, on May 9, 2000, Head of State N.A. Nazarbayev raised the question with the government about the need to replace the Anthem. As a result, in January 2006, the song “Menin Kazakhstan” became the official Anthem. The song was written in 1956 by Sh. Kaldayakov and Zh. Nazhimedenov. This march, composed during the years of virgin lands development, was created with the aim of awakening the national pride and spirit of the Kazakh people. It was also played in December 1986.

President of the Republic of Kazakhstan N.A. Nazarbayev played a special role in the process of adopting State symbols. Having made some amendments to the text that corresponded to today's ideals and goals of the country, he joined the united team of authors. “During the adoption of the first symbols of Independence, the Head of State paid special attention to the use of the state language, terms in the Kazakh language,” recalls Erbol Shaimerdenov. “He crossed out the words “coat of arms”, “hymn”, “symbol” with his own hand and replaced them with “eltanba” , “Anuran”, “nyshan, ramiz”. Today our State symbols are widely known in the world. The Republic of Kazakhstan is recognized by the whole world. The flag of our country flies on the flagpole in front of the United Nations building and foreign missions of Kazakhstan. The Kazakh Blue Flag traveled to space together with Talgat Musabayev. During award ceremonies for Kazakhstani athletes at international competitions, our Anthem is played and the Blue Flag is raised. All this is a source of special pride for every citizen of the Republic of Kazakhstan.
