The administration of the Saransk urban district has developed recommendations for organizing the work of a small retail trade network, which includes temporary summer cafes. This year in Saransk, permission to operate 42 summer cafes was issued, including 20 non-alcoholic cafes intended for families with children.
Summer cafes will be open from May 1 to September 30. According to the rules developed by the Administration of Saransk, temporary summer cafes should not interfere with the free movement of pedestrians and vehicles, limit visibility for road users, create a threat to the life and health of people, the environment, fire safety of property, and also violate the existing aesthetic environment and the architectural appearance of the city . Cafes cannot be located in areas adjacent to religious institutions, monuments, sources of increased danger, as well as residential buildings.
The recommended operating hours are until 23.00, but according to the law, it is set by the owner independently, provided that the living and recreational conditions of people in residential buildings do not deteriorate. The operation of sound and video reproducing equipment in summer cafes is permitted from 10.00 to 23.00 with the music volume not exceeding the maximum permissible standards. Organizing concerts with performances by vocal and instrumental ensembles and soloists in open areas adjacent to summer cafes is permitted only in recreation areas (parks, squares).
The areas of summer cafes must be landscaped. Modern artistic, decorative and lighting design should be used - designs in bright colors, inside there must be a floor covering - linoleum, paving stones. Cafes must be provided with commercial and technological equipment and inventory, refrigeration equipment for separate storage of semi-finished and finished products. In addition, summer cafes must have documents confirming the origin, quality and safety of products and semi-finished products used to prepare the products sold.
The cafe owners are also responsible for the improvement of the surrounding area - landscaping, sidewalks. Near the cafe there should be garbage bins, at least 2 euro containers for waste, as well as at least 2 own dry closets. Summer cafes must be at least 5 meters away from highways.

SNiP requirements for placing catering establishments in residential buildings:

According to SNiP standards, only those shops, cafes and restaurants that do not have a harmful effect on humans can be located in the ground, first and second floors of a residential building. Thus, it is forbidden to place: specialized stores of mosquito chemicals and other goods, the operation of which may lead to pollution of the territory and air of residential buildings; stores containing explosive substances and materials; stores selling synthetic carpets, auto parts, tires and automobile oils; specialized fish stores; warehouses for any purpose.

2. Establishments that operate after 11 p.m. cannot be located in residential buildings.

After the signing of new SNiP requirements on December 26, 2014, shops and cafes with 24-hour operation were banned. From July 1, 2015, all catering establishments in residential buildings will have to switch to a different operating mode - from the established morning opening hours to 23.00.

Previously, this norm was applied by establishment owners on a voluntary basis.

3. Public premises cannot be loaded from the courtyard of a residential building.

SNiP rules also regulate the occupancy of various establishments in residential buildings. Thus, furniture, food and other things cannot be loaded from the courtyard of a residential building. However, it is possible to load premises from the ends of residential buildings that do not have windows, underground tunnels, or from the streets if there are special loading premises.

4. Establishments in residential buildings should be located in quiet places.

Various establishments should be located on the ground floors of residential buildings, including catering establishments, in places with the least exposure to noise, vibration and other harmful factors.

5. The walls of establishments should be no more than 3 m.

The height of the floors of auxiliary buildings and other additional structures in residential buildings should be no more than 3.3 m.

However, there is a small amendment to this paragraph - the height of the walls of a built-in establishment can be 3.6 or even 4.2 m, if at least 60% of the floor area is intended to accommodate dining halls and meeting rooms with an area of ​​more than 300 m.

6. If the cafe seats up to 300 people, then it can be placed on any floor of the building.

SNiP standards also provide for the ratio of capacity in meeting rooms and canteens to the floor number. For example, if the capacity of the hall is up to 300 people, then it can be placed on any floor of the building, or from the first to the third; if it is over 300, then the establishment must be located from the first to the fifth floor.
7. There should be two emergency exits in the extension.

The number of emergency exits from auxiliary buildings or premises, as well as from built-ins (inserts) must be at least two.

Also, catering establishments and others should be provided with natural lighting and automatic fire alarms.

8. All cafe employees must be provided with lunch.

At industrial enterprises, which are located not only in residential buildings, there must be premises to provide all workers with public catering. Moreover, employees of the establishment must be provided not only with general food, but also, if necessary, with dietary and therapeutic-and-prophylactic food.

It is worth adding that if the number of people working in a shift does not exceed 200 people, then buffets should be organized for them with hot dishes delivered from other catering establishments; if it exceeds, then canteens. And if the number of employees is less than 30 people, then to feed them it is enough to organize a meal room, the area of ​​which should be at least 12 m2.

9. If people come to a catering establishment in street clothes, then there should be a dressing room.

In the dining room serving visitors coming in street clothes, a dressing room should be provided, the number of seats in which should be taken equal to 120% of the number of seats intended for visitors coming in street clothes.

10. Establishments must have washbasins.

Any catering establishments must have washrooms and restrooms, and it is allowed to place washrooms in the vestibules of restrooms.

11. It is better to place a cafe near production.

The SNiP rules recommend placing canteen halls on the floor closest to the floor of the industrial building with the largest number of workers, or on the floor closest to the transition level in the industrial building.

12. One place for four people.

According to the requirements for the placement of cafes and canteens, the number of places for working personnel should be calculated in the ratio 1 place = 4 people. Naturally, depending on the organization of work, the number of places for workers may vary.

Who initiated the ban on the operation of cafes in residential buildings after 11 pm?

In 2011, State Duma deputies took the initiative to ban night trading in stores located in residential buildings. The main reason for the ban, in their opinion, should have been night trips to the store by citizens, which ultimately “could lead to a violation of the rights and legitimate interests of citizens living in residential premises in such an apartment building.”

He appealed to the Ministry of Industry and Trade with a request to delay the entry into force of the ban (July 1, 2015). As Danilenko wrote in a letter addressed to Deputy Minister of Industry and Trade Viktor Yevtukhov, limiting the operation of establishments at night in the current economic realities can lead to a drop in enterprise profits and an increase in costs, which will ultimately lead to an increase in prices for products sold.

The executive director of the Union of Independent Networks of Russia, Sergei Kuznetsov, also spoke out against it. In his opinion, the entry into force of the ban will hit small and medium-sized businesses hard. I don’t feel sorry at all that entrepreneurs will have to limit the opening hours of cafes and restaurants. For 9 years we have been suffering from 24-hour cafes on the 1st floor in our two-story apartment building built before 1900. We have 15 apartments, and THREE cafes!!! Everyone is working around the clock, violating our rights. For years we have not been able to sleep at night because of the noise, music, yelling, screaming, smoking under the windows and in cafes without soundproofing, etc. and so on. Cars are constantly driving up and making noise under the windows, parking on the lawn, right under the sign prohibiting stopping. Wherever we turned during this time, we did not receive help or protection of our rights. Meanwhile, entrepreneurs become impudent and behave disgracefully, disregarding those around them. Maybe, finally, they will pay attention to the problems of ordinary residents and help stop the chaos. After all, we also have the right to rest at night and live peacefully in our own apartments. Or will everything continue to revolve around money? We are all for the new SNIP. We just don’t understand how it will be implemented.
